If approved this application could encourage other applications for use of sites in the National Park for motorised recreational activities which would, by virtue of precedent, be more difficult to refuse so leading to a further decline in the speial qualities of the National Park and the amenities enjoyed by its residents.


Reasons 1

The likely use of Langdale Forest by 4 by 4 vehicles in the manner proposed would by virtue of the physical damage to the forest tracks together with the increased vehicular activity, noise and disturbance, seriously harm the special qualities of this part of the National Park contrary to the provisions of Policies R1, GP1 and GP3 of the North York Moors Local Plan and contrary to the National Park's statutory purposes set out in the Environment Act 1995 and in particular Section 62 which states that where there is a conflict between the two statutory purpose of conservation and promoting opportunities for enjoyment, greater weight shall be attached to the purpose of conserving and enhancing the natural beauty, wildlife and cultural heritage of the National Park.

The operation of All Terrain Vehicles in Langdale forest and its effects on the National Park's special qualities outlined above, would conflict with and harm the enjoyment by others of these special qualities of this remote and isolated part of the National Park and so conflicts with Policy R1 of the North York Moors Local Plan which permits proposals for recreational activities only where the activity does not conflict with other users of the National Park.

The proposed use would adversely affect the amenities of local residents by reason of the noise and disturbance associated with traffic movements to and from the site and the use of the car park in a remote and isolated rural location contrary to the provisions of Policy GP3 of the North York Moors Local Plan.
