The site lies outside the main settlement of Stainsacre and does not consititute an infill plot, as it is not a small gap in an otherwise continuous built up frontage. The site is considered to constitute backland development which if permitted would poorly relate to the layout, form of the village and would have a detrimental effect on the environment and character of this part of the North York Moors National Park. As such the proposal is contrary to Policy H1 of the North York Moors Local Plan.
The proposed development by reason of its tandem layout and shared drive would be likely to result in unacceptably low levels of residential amenity to current and future occupiers of Windy Ridge and Bridge Cottage by reason of disturbance and loss of privacy. As such the proposals would be contrary to the provision of Local Plan Policy GP3 which seeks to ensure development would not adversely affect the operation of adjacent land users.
